-
These GTC form an integral part of every Contract concluded between the Seller and the Buyer. Different arrangements in an individual Contract take precedence over the wording of these GTC.
Article II — Definitions
For the purposes of these GTC:
-
Buyer means a natural person or legal entity that has concluded a Contract with the Seller.
-
Consumer means a natural person who, when concluding and performing the Contract, is not acting within the scope of their trade or other business activity, employment or profession (Section 2(a) of Act No. 108/2024 Coll. on Consumer Protection — hereinafter the “Consumer Protection Act”).
-
Business Customer (B2B buyer) means a person who is not a Consumer, in particular a person registered in the commercial register, a person doing business on the basis of a trade licence or another person acting within the scope of their business activity. The relationship between the Seller and a Business Customer is governed by Act No. 513/1991 Coll., the Commercial Code, as amended.
-
Goods means a movable tangible item that is the subject of the Contract, including goods made according to the Buyer’s specific requirements (custom-made goods).
-
Custom-made Goods means goods made according to the Buyer’s specific requirements, goods made to measure or goods intended specifically for one Buyer, in particular: a) products made by 3D printing according to a 3D model supplied by the Buyer (.STL, .STEP, .OBJ, .3MF and other formats), b) products made by laser cutting or engraving according to vector artwork supplied by the Buyer (.SVG, .DXF, .AI, .PDF and other formats), text, a photograph or another graphic element, c) products made on the basis of a drawing, photograph or other material converted by the Seller into production documentation and approved by the Buyer.
-
Online Shop means the online shop operated by the Seller on the Website, offering standardised goods (e.g. ready-made decorative items).
-
Enquiry means a non-binding request by the Buyer for a quote for Custom-made Goods submitted through the contact form, the chatbot or by e-mail.
-
Quote means a binding or non-binding proposal by the Seller to conclude a Contract, with a specific price, delivery date and specification of the Goods.
-
Contract means a contract concluded between the Seller and the Buyer under these GTC, in particular a purchase contract under Section 588 et seq. of the Civil Code or a contract for work under Section 631 et seq. of the Civil Code (for a Consumer), or the relevant contract under the Commercial Code (for a Business Customer).
Article III — Subject Matter of the Business Relationship
-
The subject of the Contract is the Seller’s obligation: a) to manufacture and deliver Custom-made Goods according to the Buyer’s specification and materials, or b) to sell and deliver standard Goods from the Online Shop, and the Buyer’s obligation to accept the Goods and pay the agreed price.
-
The Seller provides in particular the following services: a) 3D printing using FDM/FFF technology from plastic and composite materials (PLA, PETG, ABS, ASA, TPU, carbon-fibre-filled materials and others), b) laser cutting and laser engraving (wood, acrylic, leather, stainless steel, aluminium and other materials compatible with the Seller’s technology), c) graphic preparation and CAD processing of the Buyer’s materials, d) supplementary sale of standard goods through the Online Shop.
-
The Seller reserves the right to refuse an order if: a) the supplied materials cannot technically be produced on the Seller’s production equipment, b) the subject of the order is contrary to the law, good morals or public order, c) the subject of the order infringes the intellectual property rights of third parties (trade marks, copyright, personality rights, etc.) and the Buyer does not prove that they are authorised to use them, d) the Buyer repeatedly breaches their obligations towards the Seller.
Article IV — Order and Conclusion of the Contract
A. Ordering Custom-made Goods (main workflow)
-
The process of concluding a Contract for Custom-made Goods consists of the following steps:
Step 1 — The Buyer’s Enquiry. The Buyer sends the Seller an Enquiry through the contact form on the Website, the chatbot, by e-mail or by telephone. The Enquiry contains in particular the required technology, a description of the required product, the quantity, materials (3D model, vector, photograph, sketch) and the Buyer’s contact details.
Step 2 — The Seller’s Quote. Within a reasonable period (usually within 48 hours on working days), the Seller sends the Buyer a Quote containing the price including VAT, the expected production and delivery date, the material specification and any technical reservations. The Quote is binding for the period stated in it (if no period is stated, for 14 calendar days).
Step 3 — Approval of the Quote. The Buyer approves or rejects the Quote in writing (by e-mail or by other verifiable means). The Buyer’s approval of the Quote concludes the Contract in accordance with these GTC, unless the Quote itself states otherwise.
Step 4 — Approval of the graphic or 3D design (see Article V). If the nature of the order requires graphic or modelling work, the Seller sends the Buyer a visualisation (render, PDF preview, sample cut, etc.) for approval before production starts. The Buyer either approves the design or requests changes.
Step 5 — Payment. After the graphic/3D design has been approved, the Seller issues the Buyer an advance invoice (advance payment document) in accordance with Article VI of these GTC. The Seller starts production once the payment has been credited to its account or — if payment on receipt has been agreed (cash on delivery, cash on personal collection) — immediately after the design has been approved.
Step 6 — Production and delivery. The Seller makes the Goods in the agreed quality and within the agreed period and delivers them to the Buyer in the manner agreed in the Contract (Article VII).
-
Each step of this process is documented through e-mail communication or in the Seller’s internal system (chatbot, customer portal). The Buyer acknowledges that electronic communication has the same legal effect as the written form (Section 40(4) of the Civil Code).
B. Ordering standard Goods from the Online Shop
-
When standard Goods are ordered from the Online Shop, the Contract is concluded at the moment the Seller sends an order confirmation to the Buyer’s e-mail address stated in the order. A prior Quote and design approval are not required.
-
Information on the Website about goods, prices, availability and delivery times does not constitute a proposal to conclude a contract within the meaning of Section 43a of the Civil Code. Only the order sent by the Buyer is considered a binding proposal to conclude a contract.
Article V — Approval of the Graphic and 3D Design
-
If the nature of the order requires graphic or modelling work on the materials supplied by the Buyer (for example creating a vector from a photograph, positioning a logo on a base, modifying a 3D model), the Seller submits a visualisation of the final product or a sample output to the Buyer for approval before production starts.
-
The visualisation is for illustration only. The actual appearance of the manufactured Goods may differ from the visualisation within technologically determined deviations, in particular: a) colour and gloss — real colours may differ from how they are displayed on the Buyer’s monitor, b) surface texture — the usual characteristics of the production process concerned (layering in 3D printing, slight burning of the edge in laser cutting, a change in surface shade when engraving), c) dimensional deviations within the Seller’s production tolerances, which for FDM 3D printing and for laser cutting are usually ± 0.5 mm, unless a stricter tolerance has been agreed in the Contract.
-
The Buyer must either expressly approve the design (for example by replying by e-mail “I approve”, “OK”, “Please proceed with production”) or send specific comments. The Seller starts production only after the Buyer has verifiably approved the design.
-
Once the Buyer has approved the design, the Buyer’s right to make any claims against the Seller on the grounds that the manufactured Goods do not match the approved design lapses, except for an obvious error by the Seller during production (for example incorrect placement of engraved text, the wrong material, etc.) under the Complaints Procedure.
-
The Buyer is responsible for the correctness of texts, spelling, grammar, image materials, dimensions and other data supplied to the Seller for the manufacture of the Goods. The Seller does not check this data for language or content and is not liable for any errors in the approved design that the Buyer did not raise before approving it.
-
The Buyer declares and is responsible for ensuring that they are entitled to use the supplied materials (logos, images, texts, portrait photographs, etc.) for the purpose of manufacturing the Goods and that their use does not infringe the rights of third parties. If third parties make claims against the Seller on the grounds of unauthorised use of the materials, the Buyer undertakes to indemnify the Seller in full.
Article VI — Price and Payment Terms
-
All prices stated on the Website, in the Quote or in the advance invoice are final prices, i.e. including VAT at the statutory rate of 23%, unless expressly stated otherwise. The Seller is a VAT payer.
-
The Seller accepts the following methods of paying the purchase price: a) bank transfer on the basis of an advance invoice to the Seller’s account stated on the invoice. The purchase price is considered paid on the day the full amount is credited to the Seller’s account; b) cash on delivery — the Buyer pays the price to the courier or delivery person on receipt of the parcel; c) in cash on personal collection at the Seller’s premises.
-
Online payment by card is currently not supported. If the Seller introduces this option in the future, the conditions for its use will be added to these GTC.
-
For Custom-made Goods, the Seller is entitled to require payment of a deposit of 50% of the purchase price before production starts, with the remaining 50% of the purchase price payable before delivery, on cash on delivery or on personal collection (according to the payment method agreed in the advance invoice). The reason for requiring a deposit is that Custom-made Goods usually cannot be sold to another customer after production. In justified cases (in particular for unusually expensive materials or for Buyers with a negative payment history), the Seller reserves the right to require a higher deposit of up to 100% of the purchase price; the amount of the deposit is always stated in the Quote or in the advance invoice.
-
In addition to the price of the Goods, the Buyer also pays the delivery charge according to the chosen delivery method (Article VII). For cash on delivery, the Buyer also pays the cash-on-delivery fee in the actual amount charged by the carrier, of which the Buyer is informed before sending the order.
-
The Seller issues the Buyer a tax document (invoice) in accordance with Act No. 222/2004 Coll. on Value Added Tax and Act No. 431/2002 Coll. on Accounting. The tax document is usually sent to the Buyer electronically to the e-mail address stated in the order. The Buyer expressly agrees to receive invoices electronically.
-
If the Buyer is late in paying the purchase price, the Seller is entitled: a) in relation to a Consumer — to claim default interest at the statutory rate under Section 517(2) of the Civil Code and Government Regulation of the Slovak Republic No. 87/1995 Coll.; b) in relation to a Business Customer — to claim default interest at the statutory rate under Section 369 of the Commercial Code and Government Regulation of the Slovak Republic No. 21/2013 Coll., including a flat-rate compensation of €40 for the costs of recovering the debt.
Article VII — Delivery Terms
-
The Seller delivers Goods within the Slovak Republic through the following carriers: a) Packeta (Zásielkovňa) s.r.o. — pick-up points and Z-Box lockers, b) General Logistics Systems Slovakia s.r.o. (GLS) — courier delivery to an address, c) Slovenská pošta, a.s. (Slovak Post) — parcels and parcel lockers, d) DHL Parcel Slovensko spol. s r.o. — courier delivery, e) personal collection at the Seller’s registered office at Okružná ulica 1309/18, 900 44 Tomášov, exclusively after a specific time has been agreed in advance by telephone or e-mail. The Seller has no fixed opening hours; the time of personal collection is agreed individually.
-
Delivery outside the Slovak Republic is possible by individual arrangement with the Seller. In such a case, the price and delivery time will be stated in an individual Quote.
-
The delivery time for Custom-made Goods is set individually in the Quote and runs from the day: a) on which the full advance payment is credited to the Seller’s account (for payment in advance), or b) on which the Buyer approves the graphic/3D design (for cash on delivery or cash on personal collection).
-
For standard Goods from the Online Shop, the delivery time is stated for each specific product. The indicative delivery time is 2–5 working days from confirmation of the order.
-
If the Seller cannot meet the agreed delivery time for reasons on its side, it will inform the Buyer without delay and agree a new delivery date with them. If the Buyer does not agree to an extension of the delivery time by more than 14 calendar days, they are entitled to withdraw from the Contract; in that case the Seller will refund all payments already made to the Buyer within 14 days of receiving the withdrawal.
-
When taking over the Goods from the carrier, the Buyer must check that the packaging is intact and, in the event of obvious defects (damaged packaging, incomplete parcel), record a reservation in the consignment note and inform the Seller without delay (at the latest within 24 hours). Later complaints about damage to the parcel during transport may not be taken into account.
Article VIII — Acquisition of Ownership and Transfer of the Risk of Damage
-
The Buyer acquires ownership of the Goods only upon full payment of the purchase price (including the delivery charge and any other agreed items). Until full payment, the Goods remain the property of the Seller (retention of title under Section 445 of the Commercial Code or Section 601 of the Civil Code).
-
The risk of damage to the Goods passes to the Buyer: a) on personal collection — at the moment the Buyer takes over the Goods; b) on delivery by a carrier — at the moment the carrier hands the Goods over to the Buyer; c) for a B2B buyer — at the moment the Goods are handed over to the first carrier for transport to the place of destination (Section 455 of the Commercial Code), unless the parties agree otherwise.
Article IX — Withdrawal from the Contract
A. Withdrawal by a Consumer from a distance contract — general rule
-
Under Section 19(1) of Act No. 108/2024 Coll. on Consumer Protection, a Consumer has the right to withdraw from a contract concluded at a distance or off the Seller’s business premises without giving a reason within 14 calendar days of taking over the Goods.
-
The right of withdrawal is exercised in writing — by e-mail to matej@imach.sk or by post to the address of the Seller’s registered office. The Consumer may use the model withdrawal form attached to these GTC (Annex No. 1).
-
If the Consumer withdraws from the Contract validly and in time, the Seller will refund all payments received from the Consumer (including the cost of delivering the Goods at the basic rate) no later than 14 days from the day it receives the notice of withdrawal. The Seller will make the refund using the same means of payment as the Consumer used, unless the Consumer expressly agrees otherwise.
-
The Seller is not obliged to refund the payments to the Consumer before the Consumer returns the Goods or provides credible evidence that they have sent them back to the Seller. The cost of returning the Goods is borne by the Consumer.
B. Exclusion of the right of withdrawal for Custom-made Goods (KEY provision)
-
A Consumer cannot withdraw from the Contract without giving a reason within the 14-day period under paragraph 1 of this Article if the subject of the Contract is Custom-made Goods within the meaning of Section 19(5) of the Consumer Protection Act, i.e. goods made according to the Consumer’s specific requirements, goods made to measure or goods intended specifically for one Consumer.
-
Custom-made Goods within the meaning of the previous paragraph include all products manufactured by the Seller on the basis of an individual order from the Consumer, in particular: a) products made by 3D printing from a 3D model supplied by the Buyer or modified by the Seller, b) products made by laser cutting or engraving with a personalised design, text, logo, name, photograph or other individualised element, c) products made to individual dimensions, materials or colours chosen by the Consumer, d) products for which the Seller submitted a design to the Consumer for approval before production under Article V of these GTC.
-
The Consumer is expressly informed of this exclusion before sending a binding order, in particular in the following documents: a) the written Quote sent to the Consumer by e-mail before the Contract is concluded, which contains clear information that it is not possible to withdraw from a contract for Custom-made Goods; b) the order form / confirmation PDF document (advance invoice or acceptance e-mail) before production starts.
By approving the Quote and/or paying the advance invoice, the Consumer confirms that they were properly, clearly and sufficiently in advance informed that it is not possible to withdraw from the contract without giving a reason within the 14-day period, and that they agree to this.
-
The exclusion of the right of withdrawal under this section does not apply to withdrawal from the contract because of a defect in the Goods (complaint). Defective performance is dealt with under the Seller’s Complaints Procedure.
C. Other exclusions under Section 19(5) of the Consumer Protection Act
- In addition to custom-made goods, the Consumer also has no right to withdraw from the contract in the other cases listed in Section 19(5) of the Consumer Protection Act, in particular for: a) goods that are liable to deteriorate or expire rapidly, b) goods that, after delivery, have by their nature become inseparably mixed with other goods, c) goods sealed in protective packaging that are not suitable for return for health protection or hygiene reasons and whose protective packaging was opened after delivery.
D. Withdrawal from the Contract by the Seller
-
The Seller is entitled to withdraw from the Contract: a) if the Buyer has not paid the advance invoice by its due date, even after an additional 7-day period granted by the Seller, b) if the Buyer does not approve the graphic/3D design within a reasonable period or does not provide the necessary cooperation, even after an additional request from the Seller, c) if, after the Contract has been concluded, it turns out that the subject of the order is technically impossible to produce or is contrary to Article III(3) of these GTC, d) for other serious reasons specified in more detail in the individual Contract.
-
If the Seller withdraws from the Contract for reasons on the Buyer’s side (in particular late payment or failure to approve the design), the Seller is entitled to compensation for the costs it has demonstrably incurred up to the moment of withdrawal (in particular the costs of graphic work, purchased material and reserved machine time).
Article X — Special Provisions for Business-to-Business Relationships (B2B)
-
If the Buyer is a Business Customer, the contractual relationship between them and the Seller is governed by these GTC as appropriate and, subsidiarily, by the provisions of Act No. 513/1991 Coll., the Commercial Code, as amended.
-
The following deviations from the general provisions of these GTC apply to a B2B relationship: a) A Business Customer has no right to withdraw from the contract without giving a reason within the 14-day period under Article IX(1) of these GTC — this right is granted by law exclusively to Consumers. b) The length of the warranty is governed by agreement between the parties; unless agreed otherwise in the Contract, the Seller provides a Business Customer with a warranty of 6 months from the day the Goods are taken over. c) A Business Customer must inspect the Goods thoroughly on receipt — visually, dimensionally and functionally — and must notify the Seller of any obvious defects (obvious manufacturing errors, damage in transport, dimensional non-conformity with the approved design, deviations from the agreed technical parameters) without delay, but no later than 3 working days after taking over the Goods. After this period has expired, the Business Customer’s claims for obvious defects detectable on inspection lapse. d) A complaint by a Business Customer will be assessed individually on the basis of the materials supplied (photographs, a description of the defect, possibly the return of the Goods) and the applicable technical tolerances stated in Article V(2) of these GTC. The Business Customer acknowledges that the statutory rights of a Consumer (in particular the 30-day period for handling a complaint and automatic replacement after 3 unsuccessful repairs) do not apply to the relationship between the Seller and a Business Customer; the assessment and handling of a complaint are governed by the Commercial Code and the individual agreement of the parties. e) The risk of damage passes to the Business Customer at the moment the Goods are handed over to the first carrier (Section 455 of the Commercial Code). f) Default interest on late payment of the purchase price is charged under Section 369 of the Commercial Code, and the Business Customer is also obliged to pay a flat-rate compensation of €40 for the costs of recovering the debt.
-
In the event of a conflict, the provisions of this Article take precedence over the general provisions of these GTC.
-
The Business Customer acknowledges that the provisions of Act No. 108/2024 Coll. on Consumer Protection do not apply to them.
Article XI — Complaints and Warranty
-
The Seller’s liability for defects in the Goods, the warranty period, the manner of making a complaint and its handling are governed by the separate Seller’s Complaints Procedure, which forms an integral part of these GTC and is available on the Website.
-
For a Consumer, the warranty period under Section 620 of the Civil Code is 24 months from the day the Goods are taken over, unless a longer warranty period is agreed in the Complaints Procedure or in the Contract.
-
Use for a purpose other than intended and the effect on the warranty. The Seller expressly draws the Buyer’s attention to the fact that Goods made from standard materials (in particular PLA and ordinary PETG without UV additives) without additional surface treatment (finish works, i.e. varnishing, filling, UV protective coating) are not intended for long-term outdoor use where they are exposed to direct sunlight, precipitation and temperature fluctuations. If the Buyer does not expressly order the Goods made from a UV-stable material (for example ASA or carbon-fibre-filled materials with UV stabilisation) or with an additional finishing treatment, and uses the Goods outdoors, such use is considered use for a purpose other than intended. A defect arising as a result of such use may, when the complaint is assessed, lead to the loss of warranty rights to the extent permitted by the applicable law. Details are set out in the Complaints Procedure. Before the Contract is concluded, the Seller informs the Buyer whether the chosen material is suitable for the intended use; the final choice of material, however, is the Buyer’s decision.
-
For a Business Customer, the warranty period is set in accordance with Article X(2)(b) of these GTC.
Article XII — Personal Data Protection
-
As the controller, the Seller processes the Buyer’s personal data to the extent and under the conditions set out in the separate document Privacy Policy, which is available on the Website and forms an integral part of these GTC.
-
The processing of personal data is necessary in particular for the performance of the Contract, for compliance with the Seller’s legal obligations (accounting, archiving of documents) and for the Seller’s legitimate interests.
Article XIII — Alternative Dispute Resolution
-
Under Act No. 391/2015 Coll. on Alternative Dispute Resolution of Consumer Disputes, a Consumer has the right to contact the Seller with a request for redress if they are not satisfied with the way the Seller handled their complaint or if they believe that the Seller has violated their rights.
-
If the Seller rejects the request for redress or does not respond to it within 30 days of it being sent, the Consumer has the right to file a petition to initiate alternative dispute resolution with an alternative dispute resolution entity.
-
The list of alternative dispute resolution entities is kept by the Ministry of Economy of the Slovak Republic and is available at: https://mhsr.gov.sk/obchod/ochrana-spotrebitela/alternativne-riesenie-spotrebitelskych-sporov-1/zoznam-subjektov-alternativneho-riesenia-spotrebitelskych-sporov-1 . The competent entity is in particular the Slovak Trade Inspection (www.soi.sk).
Article XIV — Final Provisions
-
These GTC enter into force and take effect on 13.10.2026 (they replace the version effective from 23.04.2026) and are binding for all Contracts concluded between the Seller and the Buyer after this date.
-
The Seller reserves the right to change these GTC unilaterally at any time. The amended GTC enter into force and take effect on the day they are published on the Website. Contracts concluded before the amended GTC take effect are governed by the original version of the GTC valid at the time the Contract was concluded.
-
If any provision of these GTC is invalid or ineffective, the other provisions of the GTC remain valid and effective. The invalid provision is replaced by a provision corresponding to the purpose of the invalid provision in accordance with the relevant legislation.
-
Legal relationships between the Seller and the Buyer not governed by these GTC are governed: a) for a Consumer, in particular by Act No. 40/1964 Coll., the Civil Code, Act No. 108/2024 Coll. on Consumer Protection, Act No. 22/2004 Coll. on Electronic Commerce and other consumer protection legislation; b) for a Business Customer, in particular by Act No. 513/1991 Coll., the Commercial Code, and related legislation.
-
The contracting parties have agreed that the general court of the Seller has jurisdiction to resolve disputes arising from contractual relationships between the Seller and a Business Customer. This provision does not apply to Consumers.
-
By accepting the Contract (by approving the Quote, sending an order in the Online Shop or by other verifiable means), the Buyer confirms that they have read these GTC, understand them, agree with them and undertake to comply with them.
